I know I'm not a regular member of this board, but I thought I'd share this. This could be useful information to keep in mind as you make your decision about moving, since it involves the Ezboard TOS; the very document they stood behind after the hack of 2005.

Mind you this information is assuming they did not have permission from Myspace first...and knowing them, this is entirely possible.

Anyway, Ezboard/Yuku was having difficulty explaining its TOU/TOS policy as previously written to concerned members. In essence, it appeared that whatever was created on ezboard by users became defacto Ezboard property, free to offer to 3rd parties etc. So, to quell this concern, Robert Labatt (current CEO since Vanchau left or was removed) quickly had the TOU/TOS rewritten...claiming that he did not really look at it, despite being on the job for 2 years+ now. He announced the re-writing and apparently most users were satisfied.

What he did NOT say was that the "revision" is in essence a cut and paste job of the Myspace TOU.

...again, this assumes that Ezboard did not have prior permission from Myspace to copy the work of Myspace's lawyers in drafting the Myspace TOU.

Also there remains the fact that Ezboard can still do whatever it wants with user posted content, so long as it remains within Ezboard itself:

There is still some question about what they mean by "solely on and through the ezboard Services." Labatt says it's just for ezboard and not meant for 3rd parties, but if 3rd party affiliates support ezboard and are considered part of ezboard services...well who knows?
